Former Lawrence County Sheriff Jimmy Brown and Captain Adam Brewer were back in court Thursday facing a motion hearing on misconduct charges.

The hearing was postponed until April 23. Brown is facing additional charges including tampering with evidence and use of inmates for personal gain.

Both defendants has entered pleas of not guilty to the charges.

Judge David Allen  took Attorney General Ray Crouch to task after arriving 1 1/2 hours late to the proceeding.

Judge Allen found Crouch in Contempt of Court and levied a fine accordingly. Allen then expressed concern that other judges in the 22nd Judicial District have recused themselves from the case and they would likely be called as witnesses if the matter goes to trial.

He also asked attorneys for the prosecution and defense to discuss whether he should also recuse himself and Crouch presented a motion.

Judge Allen took the motion under advisement and requested  attorneys from both sides to submit written arguments concerning the matter. He promised to rule on or before April 23 and postponed the haring of motion until that date.

Following adjournment, Defense Attorney Ben Boston stated that such a delay is part of the judicial process and his team will respond to Judge Allen's request for arguments and will be prepared to appear in court again on April 23.
