TESTIMONY IS EXPECTED TO BEGIN TODAY IN CAPITAL MURDER TRIAL OF THE SHOOTING DEATH OF KI-JANA FREEMAN. ACCORDING TO THE TIMES DAILY, PETER CAPOTE, 24, OF MUSCLE SHOALS, IS CHARGED WITH CAPITAL MURDER, FIRST DEGREE ASSAULT AND DISCHARGING A GUN INTO AN OCCUPIED VEHICLE. CAPOTE IS THE SECOND OF FOUR PEOPLE WHO HAVE BEEN CHARGED WITH CAPITAL MURDER FOR THE INCIDENT THAT OCCURRED ON MARCH 1ST, 2016. BENJAMIN OWEN YOUNG, THOMAS HUBBARD AND RILEY HAMM III, HAVE ALSO BEEN INDICTED. YOUNG WAS FOUND GUILTY OF CAPITAL MURDER ON FEB 7TH AND ON MARCH 13TH WAS SENTENCED TO DEATH. A FIFTH SUBJECT, DEVONTAE BERNARD BATES WAS INDICTED FOR CRIMINAL CONSPIRACY AND PLEADED GUILTY TO THE CHARGE. DURING TESTIMONY AT A PRELIMINARY HEARING, POLICE ADVISE MORE THAN A DOZEN SHELL CASINGS WERE FOUND AT THE SCENE OF THE SHOOTING AND THE VEHICLE FREEMAN WAS IN HAD 12 BULLET HOLES ON THE DRIVER'S SIDE. TESTIMONY DURING YOUNG’S TRIAL INDICATE THE SHOOTING WAS GANG RELATED. CAPOTE, HUBBARD, HAMM AND YOUNG ARE BEING HELD WITHOUT BAIL IN THE COLBERT COUNTY JAIL.
